All statements, technical information and recommendations about AWT Healthcare products are based upon AWT Healthcare’s information and belief; in some instances, derived in whole, or in part, from tests believe to be reliable, but no statement, technical information, recommendation or test made, relied upon or communicated by AWT Healthcare is intended, nor shall it be deemed, to constitute a guarantee or warranty, nor may any PURCHASER rely upon any of such information in making a determination as to the sustainability of any AWT Healthcare’s products for its intended purposes. 

All AWT Healthcare products are sold with the understanding that PURCHASER has independently determined the sustainability of AWT Healthcare products for its intended purposes. AWT Healthcare products are warrantied to be free of defects in material or workmanship for a period of two years from date in conversion. 

Any AWT Healthcare product proven, to the reasonable satisfaction of AWT Healthcare, within the time provided, to be defective in material or workmanship shall, at AWT Healthcare’s option, either be rectified by AWT Healthcare providing replacement product free of defects at no charge or, alternatively, by AWT Healthcare issuing a credit in the sum of the amount paid by the PURCHASER, pro-rated in the instance when only a portion of the material is defective. 

All expenses of production of replacement AWT Healthcare product free of defect shall be borne by AWT Healthcare, but AWT Healthcare shall not be responsible for any costs associated with PURCHASER’s use of AWT Healthcare product provided as a replacement. In no event shall AWT Healthcare be responsible for claims beyond the price paid by the PURCHASER for the defective product or in any way liable or responsible for consequential or incidental damages. 

No express warranties and no implied warranties, whether of merchantability or fitness for any particular use, purpose or otherwise, except as set forth above (which is made expressly in lieu of all other warranties) shall apply to to products sold by AWT Healthcare. AWT Healthcare specifically disclaims and excludes all other such warranties, no waiver, alteration, addition or modification of the foregoing conditions shall be valid unless made in writing and signed by an executive officer of AWT Healthcare.  No salesman, representative, or agent of AWT Healthcare is authorized to give any guarantee, warranty or make any representation contrary to the above.
